DHS Held In Contempt Over Inmate Transfers

A Sangamon County judge has found the Illinois Department of Human Services and its director to be in “indirect civil contempt” of court for failing to transfer county jail inmates for appropriate mental health treatment.

 

The department and Secretary Grace Hou are being fined $100 a day in the case of county jail inmate Breawna Miller, who was found to be mentally unfit for trial back on September 8th, starting a 20-day clock for her transfer. But as of Friday afternoon, Miller was still in the county jail.

 

The court found that DHS has not provided “legally sufficient” reasons for failing to transfer Miller and other inmates within the deadlines under the law.
