Governor JB Pritzker is asking Illinois Attorney General Kwame Raoul to file an expedited appeal with the Illinois Supreme Court in the legal battle over masks in schools.

After a Sangamon County judge struck down Pritzker’s executive order mandating masks for students and teachers, Pritzker filed an appeal. But the 4th District Appellate Court late Thursday denied Pritzker’s request to overturn the lower court decision. In a statement, Raoul says he will file the appeal with the high court, and contends the appellate court decision does not impact the enforceability of Pritzker’s executive order.

Raoul says the three-judge appeals panel’s decision “does fundamentally misapply important principles of Illinois law.”
